Welcome to Successmap! These Terms and Conditions (“Terms”) govern your access to and use of Successmap’s services, applications, and websites (collectively, the “Service”). By using Successmap, you agree to these Terms. If you do not agree, do not use our Service.

1. Agreement to Terms

These Terms and Conditions ("Terms") constitute a legally binding agreement between you ("you," "your," or "User") and SuccessMap ("we," "our," or "us") governing your access to and use of our website, platform, services, curriculum, AI system, community, and coaching (collectively, the "Services").

By accessing or using SuccessMap, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our Services.

2. Eligibility

To use SuccessMap, you must:

  • Be at least 18 years of age

  • Have the legal capacity to enter into binding contracts

  • Not be prohibited from using our Services under applicable law

  • Provide accurate and complete registration information

  • Maintain the confidentiality of your account credentials

3. Account Registration and Security

3.1 Account Creation

You must create an account to access certain features of SuccessMap. You agree to:

  • Provide accurate, current, and complete information

  • Maintain and update your information as needed

  • Keep your password secure and confidential

  • Notify us immediately of any unauthorized access

  • Accept responsibility for all activities under your account

3.2 Account Termination

We reserve the right to suspend or terminate your account at our discretion if you violate these Terms, engage in fraudulent activity, or misuse our Services.

4. Services Offered

4.1 SuccessMap Includes:

  • Success Engineering Curriculum: 6 comprehensive modules covering business scaling principles

  • SuccessMap AI System: 1-year access to our proprietary AI-powered business coaching tool

  • See-Believe-Achieve System: Methodology and frameworks for sustainable business growth

  • Weekly Principle-Based Coaching: Live coaching sessions and support

  • SuccessMap Private Community: Access to our exclusive member community

4.2 Service Availability

We strive to maintain continuous access to our Services but do not guarantee uninterrupted availability. We may modify, suspend, or discontinue any aspect of the Services at any time with reasonable notice.

5. Enrollment and Pricing

5.1 Limited Enrollment

SuccessMap limits enrollment to 100 spots per enrollment period. Enrollment closes when capacity is reached. We reserve the right to modify enrollment limits and pricing for future cohorts.

5.2 Current Pricing

The launch pricing and value structure are as stated on our website at the time of your enrollment. Pricing is subject to change for future enrollment periods.

5.3 Payment Terms

  • All fees are due at the time of enrollment or according to the payment plan selected

  • Payment must be made through our authorized payment processors

  • You authorize us to charge your payment method for all applicable fees

  • Prices are stated in US Dollars unless otherwise specified

  • Late payments may result in service suspension

5.4 Taxes

You are responsible for all applicable taxes, duties, and assessments related to your purchase.

6. Intellectual Property Rights

6.1 Our Content

All content provided through SuccessMap, including but not limited to:

  • Curriculum materials, videos, and worksheets

  • AI system algorithms and outputs

  • Coaching frameworks and methodologies

  • Community content created by us

  • Branding, logos, and trademarks

is owned by SuccessMap or our licensors and protected by copyright, trademark, and other intellectual property laws.

6.2 Limited License

We grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services and content solely for your personal business development. You may not:

  • Reproduce, distribute, or publicly display our content

  • Create derivative works from our materials

  • Sell, license, or commercially exploit our content

  • Remove copyright or proprietary notices

  • Use our content to create competing products or services

  • Share your account access with non-enrolled individuals

6.3 Your Content

You retain ownership of content you create and submit to SuccessMap (posts, comments, business plans). By submitting content, you grant us a worldwide, non-exclusive, royalty-free license to use, display, and distribute your content within the Services and for promotional purposes, with attribution when publicly shared.

6.4 Feedback

Any feedback, suggestions, or ideas you provide about SuccessMap become our property, and we may use them without compensation or attribution.

7. User Conduct and Community Guidelines

You agree to use SuccessMap respectfully and professionally. Prohibited conduct includes:

  • Harassment or Abuse: Threatening, bullying, or harassing other members

  • Inappropriate Content: Posting offensive, discriminatory, or explicit material

  • Spam: Excessive self-promotion, unsolicited advertising, or repetitive posting

  • Misinformation: Sharing false or misleading business advice intentionally

  • Intellectual Property Violation: Posting copyrighted material without permission

  • Privacy Violation: Sharing others' personal information without consent

  • System Abuse: Attempting to hack, scrape, or manipulate the platform

  • Impersonation: Misrepresenting your identity or affiliation

  • Illegal Activity: Using the Services for unlawful purposes

Violation of these guidelines may result in content removal, account suspension, or termination without refund.

8. AI System Use and Limitations

8.1 AI-Generated Content

The SuccessMap AI System provides business insights, strategies, and recommendations based on machine learning algorithms. You acknowledge that:

  • AI outputs are suggestions, not guaranteed business advice

  • You are responsible for evaluating and implementing AI recommendations

  • AI cannot replace professional business, legal, or financial advice

  • Results may vary based on your specific circumstances and implementation

8.2 Data Usage

Your interactions with the AI System help improve its performance. We may use anonymized data from AI interactions to train and enhance the system. Your specific business data will not be shared with other users.

8.3 Accuracy Disclaimer

While we strive for accuracy, AI-generated content may contain errors, inconsistencies, or outdated information. Always verify critical business decisions with qualified professionals.

9. Coaching Services Disclaimer

9.1 Nature of Coaching

Weekly coaching sessions provide educational content, strategic guidance, and community support. Coaching is not:

  • Professional business consulting (unless specifically stated)

  • Legal, financial, tax, or investment advice

  • Personalized one-on-one consulting (unless purchased separately)

  • A guarantee of specific business outcomes

9.2 Your Responsibility

You are solely responsible for implementing strategies, making business decisions, and complying with applicable laws in your jurisdiction.

10. Results Disclaimer

10.1 No Guaranteed Results

While we showcase testimonials and case studies of businesses that have achieved success using our framework, we make no guarantees regarding:

  • Revenue increases or business growth

  • Timeframes for achieving results

  • Specific outcomes or metrics

  • Success applicable to your particular situation

11. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.

11.2 Limitation of Damages

SUCCESSMAP, ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS SHALL NOT BE LIABLE FOR:

  • Indirect, incidental, special, consequential, or punitive damages

  • Loss of profits, revenue, data, or business opportunities

  • Business interruption or loss of goodwill

  • Errors or omissions in content

  • Unauthorized access to your account or data

OUR TOTAL LIABILITY SHALL NOT EXCEED THE AMOUNT YOU PAID TO SUCCESSMAP IN THE 12 MONTHS PRECEDING THE CLAIM.

11.3 Exceptions

Some jurisdictions do not allow limitations on implied warranties or liability for incidental damages. In such jurisdictions, these limitations may not apply to you.

12. Indemnification

You agree to indemnify, defend, and hold harmless SuccessMap and its affiliates, officers, directors, employees, and agents from any claims, damages, losses, liabilities, and expenses (including legal fees) arising from:

  • Your use or misuse of the Services

  • Your violation of these Terms

  • Your violation of third-party rights

  • Your content or activities on the platform

  • Your business decisions based on our content or coaching

13. Third-Party Services and Links

SuccessMap may integrate with or link to third-party services (payment processors, analytics tools, external resources). We are not responsible for:

  • The availability, accuracy, or content of third-party services

  • Third-party privacy practices or terms of service

  • Any damages resulting from third-party interactions

Your use of third-party services is governed by their respective terms and policies.

14 Privacy and Data Protection

Your use of SuccessMap is also governed by our Privacy Policy, which is incorporated into these Terms by reference. By using our Services, you consent to our data practices as described in the Privacy Policy.

15. Communications

15.1 Electronic Communications

By using SuccessMap, you consent to receive electronic communications from us, including:

  • Service announcements and updates

  • Educational content and coaching materials

  • Promotional offers and marketing (you may opt out)

  • Administrative messages and account notifications

15.2 Opt-Out

You may opt out of promotional communications by following unsubscribe instructions in emails or adjusting your account settings. You cannot opt out of essential service communications.

16. Dispute Resolution

16.2 Arbitration Agreement

If informal resolution fails, any dispute arising from these Terms or your use of SuccessMap shall be resolved through binding arbitration rather than in court, except where prohibited by law.

Arbitration Terms:

  • Conducted under the rules of the American Arbitration Association (AAA)

  • Held in Delaware

  • Limited to individual claims (no class actions)

  • Each party bears their own legal fees unless otherwise awarded

  • Arbitrator's decision is final and binding

16.3 Exceptions to Arbitration

You may pursue claims in small claims court if they qualify. We may seek injunctive relief in court for intellectual property violations or unauthorized access.

16.4 Class Action Waiver

YOU AGREE TO RESOLVE DISPUTES ON AN INDIVIDUAL BASIS ONLY. YOU WAIVE ANY RIGHT TO PARTICIPATE IN CLASS ACTIONS, CLASS ARBITRATIONS, OR REPRESENTATIVE ACTIONS.

17. Governing Law and Jurisdiction

Upon termination:

  • You remain liable for all obligations incurred before termination

  • We may delete your data in accordance with our Privacy Policy

20. General Provisions

These Terms, together with our Privacy Policy and any additional policies, constitute the entire agreement between you and SuccessMap regarding the Services.

20.2 Severability

20.4 Assignment

You may not assign or transfer these Terms without our written consent. We may assign our rights and obligations without restriction.

We are not liable for delays or failures in performance resulting from circumstances beyond our reasonable control.

20.6 Relationship

These Terms do not create a partnership, joint venture, employment, or agency relationship between you and SuccessMap.

Headings are for convenience only and do not affect interpretation. "Including" means "including but not limited to."
